This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from Gould Street, LLC for a Shore Protection Act (SPA) permit under Official Code of Georgia (O.C.G.A.) 12-5-230 et. seq. for the construction of a portion of a residence, retention and privacy walls, a fire pit, and landscaping within the State’s SPA Jurisdiction, at 90 and 96 Gould Street, St. Simons Island, Glynn County, Georgia.
The applicant’s property is approximately 26,413.85 square feet (sq.ft.) (0.61 acres), of which 8,089.96sq.ft. (0.19 acres) is located within the state’s SPA jurisdiction. The property area within jurisdiction currently consists of native lawn and approximately 1,343.41sq.ft. of rock revetment.
A Letter of Permission (LOP) was issued on June 22, 2018 for the temporary placement of erosion control and construction fencing and the staging of materials and equipment. The LOP also authorized temporary impacts associated with the trenching for footers of a new residence.
Currently, the applicant is constructing a residence landward of SPA jurisdiction of which 1.08sq.ft. of the southwest corner of the residence is proposed to be located within SPA jurisdiction. Retention walls and stairs comprising 88.06sq.ft. are proposed within jurisdiction to provide access and to contain a proposed elevated yard. A portion of the elevated yard, 595.35sq.ft., is within SPA jurisdiction and is located between a pool located outside of jurisdiction and the existing lawn and serves as a transitional zone between these two features. Concrete privacy walls, 56.42sq.ft., are proposed along the property lines within jurisdiction that extend to the existing rock revetment. A proposed fire pit with seating area making up 57.88sq.ft. will be constructed with brick pavers and loose shell and gravel.
The proposed landscaping will include a 256.93sq.ft. dunescape that will be constructed immediately landward of the rock revetment. The dunescape will be constructed approximately 6’ above the existing grade using beach quality sand from an upland source. The dunescape as well as other portions of the jurisdictional area will be planted with native vegetation.
As proposed, the total existing and proposed jurisdictional impacts would be approximately 2142.20sq.ft. (26%) of the area within SPA jurisdiction. Approximately 5,947.76 sq.ft. (74%) of the State’s jurisdictional area will be retained or improved to a more natural vegetated and topographic state.
It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations: (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
